IMPORTANT NOTICE
These Terms of Use (hereinafter referred to as the "Terms") constitute a legally binding agreement between you (an individual, company, or any other legal entity) and LightMake (HK) Limited. These Terms govern your access to and use of all LightMake products, software, mobile applications, official website, cloud services, and all related resources (collectively referred to as the "Products and Services").
You must have reached the age of majority in your jurisdiction to access and be bound by these Terms. If you have not reached the age of majority, your legal guardian must consent to or enter into these Terms on your behalf. Your use of any LightMake Products and Services shall be deemed your unreserved acceptance of all provisions set forth in these Terms. If you do not agree with these Terms in full, you must not use any LightMake Products and Services. Subject to the applicable product return policy of the purchase region, you may return the LightMake physical product to the original point of purchase, authorized distributor, or retail store to apply for a refund, which may be subject to the specific return requirements of the relevant store. All product return policies shall comply with the applicable laws and regulations of the country/region where the purchase is made.
About LightMake
LightMake refers to LightMake (HK) Limited, a company registered in Hong Kong, China, collectively referred to as "LightMake," "the Company," or "We."
1. General Provisions
1.1 The Products and Services under these Terms include, but are not limited to:(1) LightMake hardware devices (including 3D printers and related peripheral equipment);(2) Client applications and software operated by LightMake (including but not limited to slicing software, device management apps, and their updates/versions);(3) The official LightMake website (and all its subdomains), cloud services, online communities, and technical support services;(4) Embedded firmware, code, documentation, user interfaces, fonts, and all copyright-protected data stored on LightMake devices or provided via our online services;(5) All updates, upgrades, patches, and supplementary features for the above-mentioned products and services provided by LightMake from time to time.
1.2 All software and firmware covered by these Terms shall be bound by this agreement, regardless of their storage form (e.g., read-only memory, hard disk, cloud storage) or acquisition channel (e.g., pre-installed on devices, authorized online download). Unless otherwise expressly agreed in a separate written agreement signed by both parties, no additional terms shall apply to the use of LightMake software and firmware.
1.3 These Terms apply to all users of LightMake Products and Services, including individual end-users, enterprise users, and authorized resellers. For enterprise users, the use of Products and Services shall also comply with the internal rules of the enterprise, and the enterprise shall bear joint liability for any violations by its employees or agents.
2. End User Software License
2.1 Subject to your strict compliance with these Terms, LightMake grants you a limited, non-exclusive, non-transferable, and revocable license to use the LightMake software, firmware, and applications (hereinafter referred to as the "Software") only on LightMake authorized hardware devices or your personal computers/mobile devices that are used in conjunction with LightMake devices.
2.2 This license is for personal, non-commercial use unless you have obtained a separate commercial use license in writing from LightMake. You shall not sell, rent, lease, sublicense, distribute, or otherwise transfer the Software or any part thereof to any third party for commercial gain.
2.3 You may make a single copy of the Software for backup or archival purposes only, provided that the copy retains all copyright, trademark, and other proprietary rights notices of LightMake. You shall not make multiple copies of the Software or distribute the backup copy to any third party.
2.4 This license shall automatically terminate if you breach any provision of these Terms, and you must immediately stop using the Software and delete all copies (including backup copies) from your devices. LightMake reserves the right to revoke this license at any time for any reason in its sole discretion.
3. Acceptance of Terms
3.1 Your completion of the LightMake account registration process, or your actual access to/use of any LightMake Products and Services (including but not limited to unboxing and using a LightMake device, downloading and installing LightMake software, or accessing the LightMake official website) shall constitute your full reading, understanding, and irrevocable acceptance of these Terms.
3.2 If you use the Products and Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the legal authority to bind such entity to these Terms, and the terms "you" and "your" in these Terms shall refer to such entity.
3.3 If LightMake updates these Terms, the updated version shall be posted on the LightMake official website with a new "Last Updated" date. Your continued use of the Products and Services after the effective date of the updated Terms shall constitute your acceptance of the revised provisions.
4. Account Registration and Security
4.1 The use of certain LightMake Products and Services (e.g., cloud services, remote device management, online communities) requires the creation of a LightMake account ("Account"). When registering an Account, you must provide accurate, truthful, legal, and valid information (including but not limited to your email address, phone number, and physical address) as required.
4.2 LightMake reserves the right to verify the authenticity of the account information you provide. If the information is inaccurate, false, incomplete, or in violation of applicable laws, we may, in our sole discretion, deny your account registration, restrict or suspend your Account functions, or terminate your Account without prior notice.
4.3 You are solely responsible for the confidentiality and security of your Account credentials (including your username, password, and two-factor authentication codes). You shall not share your Account with any third party, or use your Account for any illegal, unauthorized, or fraudulent purposes.
4.4 You must notify LightMake immediately at [support@lightmake.tech] if you discover any unauthorized use of your Account, or any breach of account security (e.g., password leakage, unusual login activity). LightMake shall not be liable for any losses or damages arising from your failure to maintain account security, or your unauthorized sharing of your Account.
5. Rules of Use
You agree to comply with all applicable laws, regulations, and these Terms when using the LightMake Products and Services. You shall not engage in any conduct that is illegal, fraudulent, disruptive, or that may damage the rights and interests of LightMake or other users. Without limiting the generality of the foregoing, you shall comply with the following specific rules:
5.1 LightMake Official Website
5.1.1 The LightMake official website provides product information, online purchasing, technical support, and other services. You shall not use any automated tools (e.g., crawlers, bots) to access or scrape data from the website without our prior written permission.
5.1.2 You shall not post, transmit, or distribute any malicious code, spam, or content that violates intellectual property rights, privacy rights, or other legal rights of third parties on the website.
5.1.3 LightMake reserves the right to modify, suspend, or terminate any part of the website (including content and services) at any time without prior notice, and shall not be liable for any losses arising therefrom.
5.2 LightMake Hardware Devices
5.2.1 You shall use LightMake hardware devices in strict accordance with the accompanying Warranty Policy etc,. You shall not disassemble, modify, or alter the device without LightMake's written authorization, except for modifications permitted by applicable open-source licenses (see Section 5.3).
5.2.2 You shall operate the device in a safe and legal manner, and shall not use the device to produce or process any items that are illegal, dangerous, or in violation of public morality (e.g., weapons, counterfeit goods, hazardous materials).
5.2.3 You shall be solely responsible for any personal injury, property damage, or other losses caused by your improper use, misuse, or unauthorized modification of the device.
5.3 LightMake Software and Firmware
5.3.1 You acknowledge and agree that LightMake software and firmware (including slicing software, device firmware) incorporate customized developments based on open-source projects. Such open-source components are governed by their respective original open-source license agreements, which are included in the software installation package or posted on the LightMake official website. You shall use the open-source components in strict compliance with the terms of the applicable open-source licenses.
5.3.2 The installation of custom firmware or modification of open-source code in accordance with open-source licenses does not automatically void the product warranty. However, LightMake shall not be liable for any hardware/software failures, data loss, or device damage caused by or attributable to the installation or use of custom firmware/modified code, and such damages are not covered under the product warranty.
5.3.3 Except for the aforementioned open-source components, all other parts of the LightMake Software (including but not limited to the graphical user interface (GUI), cloud service integration module, camera service, remote connection service, and product information management service) are the exclusive proprietary property of LightMake. For these proprietary parts, you agree not to:(1) Copy, modify, create derivative works from, decompile, reverse engineer, or disassemble the Software, or attempt to derive the source code thereof;(2) Sell, rent, lease, sublicense, distribute, or otherwise transfer the Software to any third party without LightMake's prior written permission;(3) Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices contained in the Software;(4) Circumvent or bypass any technical protection measures (TPMs) contained in the Software;(5) Use the Software for any illegal or unauthorized purpose.
5.4 LightMake Mobile Applications and Cloud Services
5.4.1 You shall use LightMake mobile applications (Apps) and cloud services only for the purposes intended by LightMake (e.g., device management, remote printing, model storage). You shall not use the Apps or cloud services to transmit any harmful, illegal, or infringing content.
5.4.2 LightMake reserves the right to modify, update, or discontinue certain functions of the Apps and cloud services at any time without prior notice to improve user experience or address technical issues.
5.4.3 The use of cloud services requires a stable internet connection, and you shall be responsible for any network fees or data charges incurred from such use. LightMake shall not be liable for any service interruptions or data transmission failures caused by your network issues.
5.5 Customer Services
When using LightMake customer services (e.g., technical support, after-sales service), you shall provide accurate information about your issue and cooperate with our support team to resolve the problem. LightMake reserves the right to refuse to provide services to any user who abuses or harasses our customer service staff.
6. Intellectual Property Rights
6.1 LightMake and its licensors own all right, title, and interest in and to all intellectual property rights related to the Products and Services, including but not limited to patents, trademarks, copyrights, trade secrets, and industrial design rights. All such rights are protected by applicable intellectual property laws and international treaties.
6.2 Without LightMake's prior written permission, you shall not use LightMake's technology, intellectual property, or brand (including the "LightMake" trademark, logo, and trade name) to develop, design, manufacture, or sell any devices, software, or accessories that compete with LightMake Products and Services.
6.3 For the open-source software provided by LightMake, you may exercise your rights in accordance with the terms of the applicable open-source licenses, but you shall not use LightMake's brand or intellectual property rights in any way that may cause confusion among consumers, or imply any endorsement by LightMake.
6.4 You are solely responsible for the legality of all 3D models, 2D patterns, and other content that you process, print, or share using LightMake Products and Services. LightMake shall not be liable for any infringement of third-party intellectual property rights (e.g., copyright, patent, trademark) arising from your use of such content. You indemnify and hold LightMake harmless from any claims, damages, or losses arising from such infringement.
6.5 If you provide LightMake with any feedback, suggestions, or ideas regarding the Products and Services (hereinafter referred to as "Feedback"), you hereby grant LightMake an unrestricted, perpetual, irrevocable, non-exclusive, fully paid-up, royalty-free license to use, reproduce, modify, distribute, and exploit such Feedback in any manner and for any purpose worldwide, without any obligation to compensate or notify you.
7. Privacy Policy and Data Usage
7.1 LightMake's collection, use, storage, and transfer of your personal data are governed by the LightMake Privacy Policy, which is posted on the LightMake official website and forms an integral part of these Terms. By using the Products and Services, you consent to the data processing practices described in the Privacy Policy.
7.2 If you choose to participate in the LightMake User Experience Improvement Program, we may collect anonymous device data (including device configuration, software usage statistics, and error log data) for the purpose of improving our Products and Services. All collected data shall be de-identified or anonymized before use, and shall not be used to identify individual users. You may opt out of this program at any time through the device settings or by contacting LightMake at [support@lightmake.tech].
7.3 LightMake shall take all reasonable technical and organizational measures to protect the security of your personal data and prevent unauthorized access, disclosure, or alteration. However, no data transmission or storage system is completely secure, and LightMake shall not be liable for any unauthorized data access caused by factors beyond our reasonable control (e.g., cyberattacks, third-party breaches).
8. Product Updates
8.1 To continuously improve product performance, security, and user experience, LightMake may provide free updates and upgrades for the Products and Services from time to time, including but not limited to firmware updates, software patches, new feature additions, and security fixes. Such updates may be delivered via automatic online download, manual installation from the LightMake website, or in-app prompts.
8.2 All product updates and upgrades provided by LightMake are subject to these Terms, unless the update is accompanied by a separate written agreement, in which case the terms of that agreement shall prevail.
8.3 LightMake devices and software may automatically check for and notify you of available updates when connected to the internet. You may choose to install the updates immediately or at a later time, but you acknowledge that failure to install critical security updates may result in potential security risks, functional limitations, or the inability to use certain Products and Services. LightMake shall not be liable for any losses or damages arising from your failure to install such updates.
8.4 LightMake reserves the right to discontinue providing updates for older versions of the Products and Services at any time, in our sole discretion, and to focus on supporting the latest versions.
9. Product Services
9.1 The Products and Services may enable you to access third-party applications, services, or content (hereinafter referred to as "Third-Party Resources"). Such Third-Party Resources are not owned or controlled by LightMake, and LightMake shall not be liable for any defects, errors, or losses arising from your use of such resources. Your use of Third-Party Resources is governed by the separate terms and conditions of the third-party provider.
9.2 LightMake provides the following core services in connection with the Products, subject to regional availability and hardware compatibility:(1) Cloud Services: Including account management, remote printing, model storage, and device status monitoring. These services may not be available in all countries/regions or in all languages, and require an internet connection and a valid LightMake Account.(2) Print Result Detection: A service that automatically detects printing errors (e.g., layer adhesion failure, spaghetti prints) and may issue warnings or stop printing in the event of serious errors. Due to technical limitations, this service may not detect all errors, and false detections may occur in special circumstances. LightMake shall not be liable for any printing losses arising from the failure of this service to detect errors.
9.3 LightMake reserves the right to modify, suspend, or terminate any of the above services at any time without prior notice, and shall not be liable for any losses arising therefrom, provided that such action is not in bad faith.
10. Third-Party Software and Content Statement
10.1 LightMake Products support the execution of standard G-code files for 3D printing, but we do not guarantee the compatibility, accuracy, or safety of G-code files generated by third-party slicing software or other third-party tools.
10.2 LightMake shall not be liable for any device damage, printing failures, or other losses caused by your use of G-code files, consumables, accessories, or software from third parties that are not authorized or recommended by LightMake.
10.3 You shall be solely responsible for verifying the legality, safety, and compatibility of all third-party software, consumables, accessories, and content before using them with LightMake Products.
11. Disclaimer of Warranties
11.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIGHTMAKE PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND.
11.2 LIGHTMAKE HEREBY DISCLAIMS ALL EXPRESS, IMPLIED, OR STATUTORY WARRANTIES, INCLUDING BUT NOT LIMITED TO:(1) WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE;(2) WARRANTIES OF ACCURACY, COMPLETENESS, OR RELIABILITY OF THE PRODUCTS AND SERVICES;(3) WARRANTIES OF UNINTERRUPTED OR ERROR-FREE OPERATION OF THE PRODUCTS AND SERVICES;(4) WARRANTIES THAT THE PRODUCTS AND SERVICES WILL NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY.
11.3 LightMake does not warrant that the Products and Services will meet your specific requirements, or that any defects will be corrected. You assume all responsibility and risk for the selection, installation, and use of the Products and Services, and for the results obtained therefrom.
11.4 You acknowledge that during the printing, calibration, or operation of LightMake devices, inserting body parts or foreign objects into the device may result in burns, pinching injuries, or other harm. You assume all responsibility and risk for any personal injury or device damage caused by such conduct.
12. Limitation of Liability
12.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIGHTMAKE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM OR IN CONNECTION WITH THESE TERMS, INCLUDING BUT NOT LIMITED TO:(1) Damages caused by your abuse, misuse, or unauthorized modification of the Products and Services;(2) Damages caused by your use of third-party software, consumables, accessories, or content;(3) Damages caused by your failure to comply with the Privacy Policy, Safety Instructions, or these Terms;(4) Damages caused by factors beyond LightMake's reasonable control (e.g., natural disasters, war, cyberattacks, government actions, network outages).
12.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIGHTMAKE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising from the use or inability to use the Products and Services, including but not limited to loss of profits, business interruption, loss of data, or cost of procurement of substitute products, even if LightMake has been advised of the possibility of such damages.
12.3 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF LIGHTMAKE TO YOU FOR ALL CLAIMS (WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, OR OTHER LEGAL THEORIES) IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE YOU PAID FOR THE SPECIFIC LIGHTMAKE PRODUCT THAT GAVE RISE TO THE CLAIM. If the claim is related to non-physical Products and Services (e.g., cloud services), the total liability shall not exceed the amount of fees you paid to LightMake for such services in the 12 months prior to the claim.
12.4 Nothing in these Terms shall affect your statutory rights as a consumer under applicable mandatory laws and regulations, which cannot be waived or limited by contract.
13. Warranty Policy
13.1 LightMake provides a limited manufacturer's warranty for all physical hardware products, the detailed terms of which are set forth in the LightMake Warranty. The Warranty Policy forms an integral part of these Terms, and governs all warranty claims for LightMake products.
13.2 The limited warranty applies only to the original purchaser of the product, and is non-transferable. The warranty period commences on the date of delivery.
13.3 Any damage to the product caused by improper use, misuse, unauthorized modification, accident, or third-party factors is not covered under the limited warranty.
14. Export Control
14.1 You may not use or otherwise export or re-export LightMake Product except as authorized by applicable laws and the laws of the jurisdictions in which the LightMake was obtained.
14.2 You shall not use the Products and Services for any military, nuclear, or other weapons-related purposes.
15. Modification of Terms
15.1 LightMake reserves the right to modify, amend, or update these Terms at any time in our sole discretion, for any reason (including but not limited to changes in applicable laws, product updates, or service improvements).
15.2 All modified Terms shall be posted on the LightMake official website with a new "Last Updated" date, and shall take effect on that date. LightMake may also notify you of material changes via email, in-app notification, or a prominent notice on the official website.
15.3 Your continued use of the Products and Services after the effective date of the modified Terms shall constitute your acceptance of the revised provisions. If you do not agree with the modified Terms, you must immediately stop using the Products and Services and terminate your LightMake Account.
16. Termination
16.1 These Terms shall remain in effect for as long as you use the LightMake Products and Services or maintain a valid LightMake Account.
16.2 LightMake may, in our sole discretion, terminate or suspend your Account and your right to use the Products and Services at any time without prior notice if you breach any provision of these Terms (including but not limited to unauthorized use, intellectual property infringement, or fraud).
16.3 You may terminate these Terms at any time by voluntarily closing your LightMake Account and ceasing all use of the Products and Services.
16.4 Upon termination of these Terms (for any reason), you must immediately stop using the Products and Services, and delete all copies of LightMake software and firmware from your devices. All provisions of these Terms that by their nature survive termination (including but not limited to Sections 6, 11, 12, 17, and 18) shall remain in full force and effect.
16.5 Termination of these Terms shall not affect any rights or obligations that have accrued prior to termination, or any claims that may arise from acts or omissions prior to termination.
17. Governing Law and Dispute Resolution
17.1 These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law principles.
17.2 Any dispute under these Terms shall be brought in the Shenzhen Court of International Arbitration, and the Parties hereby consent to the personal jurisdiction and venue of these courts.

19. Entire Terms
These Terms, the Privacy Notice, and other relevant terms, rules, and agreements constitute the entire agreement between you and LightMake regarding the use of the Products and shall supersede any prior agreements between you and LightMake concerning the use of the Products.
